These Terms of Service ("Terms") govern your use of VoluMe (the "App"), the Auralise website at auralise.net, and related services (together, the "Service"), provided by Auralise Ltd, a company registered in England and Wales, company number 17307010, registered office at 31 Salteye Road, Eccles, Greater Manchester, M30 7PJ ("Auralise", "we", "us").
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 16 years old to use the Service. By using the Service you confirm that you meet this requirement.
VoluMe is an audio playback application that builds a personalised listening profile based on your natural volume adjustment behaviour during playback, and applies a personalised sound correction accordingly. The Service includes access to a library of Creative Commons-licensed and musician-submitted music (the "Archive"), the ability to upload and play your own audio files, and, for musicians, the ability to submit original music for inclusion in the Archive.
We may modify, suspend, or discontinue any part of the Service at any time, and will give reasonable notice of material changes where practicable.
You must sign in using a valid Google account to use the Service. You are responsible for maintaining the security of your Google account and for all activity that occurs under your VoluMe account. Notify us immediately at hello@auralise.net if you suspect unauthorised use of your account.
New accounts receive a 30-day free trial with full access to the Service, including the Archive. No payment method is required to start a free trial.
After the trial period, continued access requires a paid subscription. We currently offer the following plans, with pricing as displayed in the App at the time of purchase:
Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel, change plan, or update your payment method at any time via your account page, which uses Stripe's secure billing portal.
Premium subscribers may purchase one-off credit bundles to unlock additional Archive downloads beyond their included monthly allowance. Credits are a single-purpose entitlement to download tracks within the Service only. Credits have no monetary value outside the Service, cannot be transferred, exchanged, redeemed for cash, or used for any purpose other than downloading tracks within VoluMe, and do not expire unless your account is closed.
All payments are processed by Stripe, Inc. We do not store your full payment card details. By subscribing or making a purchase, you agree to Stripe's terms of service in addition to these Terms.
Subscription fees are generally non-refundable except where required by law. If you believe you have been charged in error, contact hello@auralise.net and we will review the matter in good faith.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation.
When you submit a track for inclusion in the Archive, you confirm that you own all necessary rights to the recording and composition, or have obtained all necessary permissions, and that the track does not infringe any third party's rights.
By submitting a track, you grant Auralise a non-exclusive, worldwide, royalty-free licence to host, stream, and make the track available for download within the Service, for as long as it remains published in the Archive. You retain all underlying ownership and copyright in your work, and may withdraw a track from the Archive at any time by contacting hello@auralise.net, subject to existing downloads already made by users.
All submissions are subject to automated and, where flagged, human review before publication, including checks for duplicate or copyrighted content. We may reject or remove any submission at our discretion, including after publication if we later determine it infringes a third party's rights or violates these Terms.
Musicians earn a royalty of 10% of the download price for each paid download of their track, calculated and recorded automatically. Accrued royalties are paid out via Stripe Connect once a musician's balance reaches the payout threshold displayed in the musician portal. Musicians are responsible for providing accurate payment details via Stripe Connect and for any tax obligations arising from royalty income in their own jurisdiction.
Audio files you upload from your own device for personal playback remain your property. We do not claim any ownership over personal uploads, and they are not shared with other users or added to the Archive unless you separately submit them as a musician.
The Service, including the VoluMe application, the personalised listening algorithm, and all associated software, design, and branding, is the property of Auralise Ltd and is protected by intellectual property laws, including a provisional patent application filed with the UK Intellectual Property Office (application reference GB2615005.2). You may not copy, modify, reverse engineer, or create derivative works from the Service except as expressly permitted by these Terms or by law.
The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or that the personalised sound profile will meet your individual expectations or hearing needs. VoluMe is not a medical device and is not intended to diagnose, treat, or replace professional audiological or medical advice. If you have concerns about your hearing, please consult a qualified audiologist or medical professional.
To the fullest extent permitted by law, Auralise Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve months preceding the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.
You may stop using the Service and close your account at any time by contacting hello@auralise.net. We may suspend or terminate your access if you breach these Terms, or for any other reason with reasonable notice, except where immediate action is necessary to protect the Service or other users.
We may update these Terms from time to time. We will post the updated version with a revised "Last updated" date, and notify you of material changes by email or within the App. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
